KDD Cup 2008 Rules This competition is being sponsored by the Knowledge Discovery and Data Mining (KDD) Special Interest Group of the Association for Computing Machinery (“SIGKDD”) and administered by Siemens Medical Solutions USA, Inc., acting through the CAD & Knowledge Solutions group of its IKM Division (“Siemens”).  Siemens’ address is 51 Valley Stream Parkway, E51, Malvern PA 19355 USA. Eligibility and Registration The Competition is open to any adult planning to attend KDD 2008, except as noted below.  Each participating group must register through the competition website (www.kddcup2008.com).  Participants are welcomed either as individuals or as teams. In the case of teams, the registration must identify the team members, and one person must be designated as the team leader and will be solely responsible for receiving communications from and communicating with Siemens.  No one may submit more than five (5) entries, with entries by an individual and by teams on which that individual is a member all counting for this purpose.  Residents of Cuba, Iran, Syria, North Korea, Myanmar (formerly Burma) and Sudan are ineligible to participate.  The Competition is void in these countries and where prohibited or restricted by law. Residents of the province of Quebec in Canada are also ineligible to participate.  Also ineligible are employees of Siemens and anyone directly or indirectly related to the Competition or Siemens, as well as their immediate families and anyone residing with them.  Siemens reserves the right to limit, or restrict upon notice, participation in the Competition to any person at any time for any reason.  The conduct of the Competition is subject to all applicable federal, state, and local laws and regulations.  No purchase, expenditure or investment is required to participate. The Competition The Competition challenge, as well as the materials to be made available to entrants, the submissions that entrants are to make in order to participate, and the criteria that Siemens intends to use to select the winners, are described in www.kddcup2008.com.   The winning entries are to be chosen by Siemens in its discretion, and Siemens’ decision shall be final, binding and conclusive on all matters.  The individual or team that submitted a willing entry will be contacted by e-mail and will be invited to give a presentation at KDD 2008.  Winners must pay all fees or other expenses related to winning, including any applicable taxes.  In connection with the Competition, Siemens will be making certain data and other material available to entrants; entrants may only use that data and material for purposes of the Competition.  In particular, entrants agree not to use that data or other material for clinical purposes or for developing a commercial product.  Siemens makes no warranty about the data and other materials supplied, and entrants acknowledge that the data set will be artificial and will have some features omitted, so no conclusion may be drawn or comparison made with Siemens’ algorithms or products. By entering this Competition, entrants accept and agree to be bound by these Rules.  Entrants must comply with these rules and will be deemed to have received and understood the rules if they participate in the Competition.  All entries become the property of Siemens.  Entrants agree that if they win, SIGKDD and Siemens have the right to use, without additional compensation, the likeness, name, and city of residence of each winner in this or future promotions.  Timeline The period for registration and the deadline for submissions are as set forth at www.kddcup2008.com General Rules Chances of winning are dependent upon the number of entries received.  Siemens does not know how many entries there may be.  Siemens reserves the right to change the structure, rules and requirements of the Competition or to end the Competition at any time by modifying these rules.  Nevertheless, Siemens disclaims any responsibility to notify participants of any aspect related to the conduct, modification and/or cancellation of the Competition. Only the official rules for the Competition posted at www.kddcup2008.com and as amended from time to time shall be considered the valid rules for this Competition. Entrants agree to release and hold harmless SIGKDD and Siemens and their respective affiliates, subsidiaries, sponsors, agents, advertising, promotion, publicity and production agencies and their respective directors, officers, employees, and other representatives from any claim, loss or other liability that may arise from their participation in this Competition.  SIGKDD and Siemens and their respective affiliates decline all responsibility related to any and all claims, demands, damages, actions or causes of action whatsoever related to the Competition. Siemens is collecting personal data about entrants for the sole purpose of administering this Competition.  To the extent an entrant supplies personal information of another individual, that entrant represents that he or she has the authority and/or has obtained all necessary consents from such individual for such submission and for Siemens to collect, use and disclose such information for the purposes described above. All entries which are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by Siemens.  Siemens assumes no responsibility for misdirected entries or for failure of the website during the Competition period, or for lost, late, incomplete, stolen, misdirected, undelivered, delayed, inaccurate, garbled or illegible materials, entries, e-mail or mail; or for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, failures, connections, or availability, or for garbled or jumbled transmissions, or for unauthorized human intervention or inaccurate capture of any information, or the failure to capture any such information.  Siemens assumes no responsibility for any injury or damage to an entrant’s or any other person’s computer related to or resulting from downloading or using any material related to the Competition.  Siemens reserves the right, in its sole discretion, to reasonably suspend or cancel the Competition should any virus, bug and/or other cause corrupt the administration, security or proper operation of the Competition.  In the event the Competition is cancelled, Siemens may, in its sole discretion, determine the winners from among all eligible and non-suspect validated entries received up to the time of such action using the judging procedure referenced above. ENTRANTS WAIVE ALL RIGHTS TO CLAIM OR RECEIVE, AND NEITHER SIGKDD NOR SIEMENS SHALL BE LIABLE FOR, DAMAGES WITH RESPECT TO CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR OTHER INDIRECT LOSS (EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS).  All issues and questions concerning the construction, validity, interpretation and enforceability of these rules and the conduct of the Competition shall be governed by the laws of the United States of America and the Commonwealth of Pennsylvania, without regard for the conflicts of law doctrine of any jurisdiction.
